The Georgia Department of Community Health (DCH) is one of Georgia's four health agencies serving the state's growing population of over 10 million people. The Office of General Counsel is seeking an Open Records Officer for the Office of General Counsel. The Selected candidate must licensed to practice law in the state of Georgia.
Job Responsibilities
  • Pursuant to Georgia's Open Records Act, reviews and analyzes requests for public records from attorneys, the media, and other parties. Provides internal legal guidance for the retrieval, review, and distribution of Open Records. Determines whether Open Records are subject to redaction or withholding due to a legal exception.
  • Corresponds daily with DCH program administrators, outside vendors, and requesting parties to coordinate fulfillment of Open Records Act requests. Maintains calendar and scheduling of Open Records Act requests. Maintains database of all requests with supporting documentation in Department's electronic repository.
  • Performs a detailed review and analysis of responsive records before disclosure to remove/redact any exempt contents such as trade secret data or protected health information. Coordinates responses to requests for production of documents and other legal requests. Processes and tracks payments for Open Records Requests.
  • Serves as the Records Custodian for the agency involving at minimum, determining compliance with schedules for retention of records, determining substantive content of records for retention according to appropriate category, and certifying true and accurate copies as needed.
  • Manages and supervises the pen records paralegal.
  • Serves as the HIPAA Privacy & Security Specialist for the Department and supports the HIPAA Privacy & Security Officer. Duties include but are not limited to tracking, reporting, working with program/division/office liaisons to research and resolve potential incidences of breach, and reviewing and revising Business Associate Agreements and Data Use Agreements as needed. Maintains database of reported HIPAA incidents with supporting documentation; updates HIPAA incident logs as needed.
  • May prepare/review proposed legislation and analyze the impact of the changes.
  • Performs legal research and compiles data from references, digests, and law libraries. Gathers and analyzes data, statutes, decisions, legal articles, and documents.
  • Creates, revises, and provides training within the Department to new and existing employees, and external parties doing business on behalf of the Department.
  • Assists in the negotiation of conclusions to difficult, complex and/or sensitive issues.
  • Performs job responsibilities with minimal supervision. Serves as job expert or organization resource in assigned areas.
  • Responds appropriately to inquiries, requests for assistance, complaints, etc. from Department/division staff and external parties.
  • Coordinates functions with those of other units/divisions to resolve problems and ensure quality of services to customers.
  • Conducts legal research, and assists with varied agency assignments, including but not limited to administrative law hearings; contracts drafting, review, and/or negotiation; presiding over public notice hearings; and other assignments as delegated. Reviews various policies within the Department for legal sufficiency and revises accordingly.
  • Other duties as assigned.

Minimum Qualifications
Juris Doctorate from an accredited college or university AND license to practice law in the State of Georgia OR eligibility to sit for the next Georgia Bar examination followed by Georgia Bar exam passage and licensure to practice law in the State of Georgia within one (1) year of hiring OR reciprocity AND Three years of relevant legal experience OR Three years of experience required at the lower-level Attorney 3 (LEP022).
