Job description

The mission of the DTSC is to protect California's people, communities, and environment from toxic substances, to enhance economic vitality by restoring contaminated land, and to compel manufacturers to make safer consumer products. DTSC is part of the California Environmental Protection Agency (Cal/EPA), has more than one thousand employees, and is headquartered in Sacramento. DTSC regulates the generation, handling, treatment, and disposal of hazardous waste in California. DTSC also cleans up thousands of hazardous waste sites in California including disposal sites and industrial sites that resulted in contamination of soil and groundwater. Over the years the scope of activity of the agency has expanded significantly to include the regulation of commercial products including toys, jewelry and even food packaging as it pertains to toxic substances contained within them and the exposure of humans and the environment to these toxic substances. DTSC also protects the public health of communities and the environment from toxic contamination left behind from past industrial and commercial activities through its brownfields and environmental remediation programs under RCRA (Resources Conservation and Recovery Act), CERCLA/Superfund, as well as many other laws governing clean-up of contaminated land, water and air. As a Attorney IV you will have the opportunity to:

  • Work closely with Department management and staff on all aspects of the permitting program for hazardous waste facilities and handlers
  • Review hazardous waste management requirements for regulating hazardous waste facilities and handlers for consistency with state and federal laws, including both substantive requirements and technical adequacy
  • Represent the Office of Permitting or Department management in administrative proceedings including permit decisions, permit denials, permit revocations, suspensions of permits, and hauler's registrations
  • Review complaints, motions, and other pleadings
  • Assist in discovery and trial, including witness and expert preparation
Desirable Qualifications We Look For:
  • Experience as an attorney with federal or state court litigation
  • Experience as an attorney with federal or state laws affecting or administered by DTSC
  • Experience as an attorney enforcing environmental laws similar to enforcement work DTSC attorneys perform
  • Experience as an attorney with administrative hearings and/or enforcement proceedings
  • Experience as an attorney briefing mid- to high-level decision makers
  • Experience advancing Environmental Justice, Community Outreach, and Community Involvement
  • Experience advancing Diversity, Equity, Inclusion and Belonging in the workplace and other settings
  • Experience applying and implementing the VSP Program
  • Experience with CEQA Compliance and Litigation
  • Experience as an attorney responding to Public Records Act Requests, discovery requests, or other similar document reviews and productions
  • Experience enforcing the California Hazardous Waste Control Law
  • Experience applying and implementing the Violation Scoring Procedure program
