What You Will Do: 

The Associate General Counsel, Claims and Litigation Management will work closely with the General Counsel and Chief Counsel to manage the day-to-day legal affairs of the Company, provide counsel to management, and support operations in the areas of litigation and risk management. This position is responsible for providing strategic and operational leadership to the Claims and Litigation Management team. This includes implementation of best practices, financial responsibility for performance of claims including oversight of claim reserves and outcomes, and providing legal advice and direction related to risk management incidents and eXp customer grievances, potential claims, Claims and Litigation. This leader provides direct reporting to the General Counsel, and regularly interacts with domestic and international stakeholder contacts. This position oversees Claims and Litigation Management team members managing their own caseloads and is also active in strategies, mediations and trials with cases involving potential for high exposure and ensures cost effective and successful management of primarily Real Estate Agents and Brokers Errors & Ommissions (E&O) Claims and Litigation.  The role involves collaboration with the full spectrum of the Company’s internal and external stakeholders, including operations, accounting, people services, and other legal teams. About the Team:

The eXp World Holdings Legal team is the guiding light to ensure all departments and business lines get the legal support and direction they need. While legal operations is primarily responsible for monitoring and assessing legal risks for the company, it is also proactive in developing and collaborating on innovative business practices in order to solve business issues and support eXp’s continued growth goals.

How You Will Make An Impact:

  • Proactively and strategically manage a complex, diverse portfolio of claims, litigation and investigation matters by assessing actions of the team and providing guidance as necessary. 
  • Provide leadership and supervisory responsibility for a group of high-performing attorneys and legal professionals maintaining best practices in Claims and Litigation Management, e-discovery, and
  • professional development.
  • Make recommendations to leadership relative to business planning with goals and objectives for the team.
  • Utilize reporting to develop metrics and manage performance of the team, as a whole, and the individual team members.
  • Track and analyze litigation metrics, as well as forecast claim trends, to counsel business partners on costs associated with frequently encountered fact patterns and identify cost-saving measures in
  • Litigation Management.
  • Meet with Claims and Litigation Management team to roundtable issues within their caseloads.
  • Develop engaged employees through regular coaching and feedback to deliver business results. 
  • Execute process improvements, provide feedback on the process and lead organizational process changes.
  • Meet with leadership to review issues, trends, and recommendations to further influence and create a culture of continual quality improvement.
  • Mentor and provide guidance to the Claims and Litigation Management team.
  • Lead calibration exercises ensuring consistency through the exchange of ideas and strategies.
  • Manage budget preparation, budget management, setting team goals, and planning for future support needs.
  • Report to and consult with the General Counsel, Chief Counsel and senior management on issues arising in litigation and regulatory matters, and with respect to insurance-related matters.
  • Coordinate with other legal groups on regulatory, compliance, and operational issues.
  • Work collaboratively with a broad range of people to develop and maintain strong working relationships between legal, finance, people services, operations, marketing & communications, and
  • growth & attraction teams and facilitate a team-based approach.
  • Partner closely with the General Counsel and Chief Counsel on the full range of issues affecting the Company, offer strategic advice, and play an important leadership role in the legal department and
  • Company.
  • Provide strategic, creative, and proactive legal support to all areas of the Company.
  • Develop and execute on strategy for the Company’s litigation and pre-litigation matters, including identifying and analyzing legal issues; working with local counsel to prepare key documents and
  • memoranda; and seeking proactive solutions to avoid future disputes across the Company.
  • Provide general support to the legal function by handling other legal matters and projects, as applicable.
  • Spearhead and support the legal function initiatives aimed at streamlining and improving upon legal processes and policies
  • Juggle and successfully prioritize competing workstreams.
  • Be flexible and willing to work on and/or lead projects in other areas.

How You Will Grab Our Attention:

  • J.D. degree from an accredited US law school.
  • Good standing member of a State Bar Association.
  • Minimum 12-15 years of in-house progressive claims/Litigation Management experience with a minimum 7 years of supervisory and/or management experience in claims/Litigation Management
  • Minimum 5 years of experience defending/managing litigation docket is preferred.
  • Computer skills in Google and Microsoft products. Experience with Trello, CounselLink and Workplace a plus.
  • An uncanny ability to both see the “big picture” on a macro-level as viewed by leadership, and employ granular attention to detail on a micro-level as and when required on a project-specific basis.
  • Be a genuinely friendly person, as there is no room for private-practice, “big-law” egos.
  • An ability to communicate legal concepts to business team members in plain English, but to also understand and employ “legal-speak” as and when needed when conferring with other lawyers, or
  • supporting the Claims and Litigation Management team’s Claims and Litigation handling activities.
  • An ability to monitor and manage the bandwidth and morale of your direct reports, knowing when to reallocate work and/or employ outside counsel.
  • Proven experience working in a high claims volume company and demonstrated strong business acumen.
  • Proven experience in Claims and/or litigation project management to direct the cost-effective deployment of resources.
  • Experience and/or familiarity with insurance coverage for litigation and/or claims.
  • Interest in and understanding of the Company’s products and services.
  • Demonstrate leadership and professional demeanor and is responsible for portraying an example of excellence in every encounter.
  • Demonstrated ability to function as the leader of a highly-motivated team.
  • Demonstrated ability to supervise and develop Claims and Litigation Management attorneys and other Claims and legal professionals, and do so while working remotely.
  • Superior written, verbal, and interpersonal communication skills with an acute ability to listen attentively and to communicate effectively throughout all levels of the organization.
  • Results-driven with the ability to meet deadlines. 
  • Excellent negotiation skills, and a firm grasp of the cost-effectiveness of settlements in appropriate cases.
