Responsibilities
Job Summary
The Assistant General Counsel - Litigation - Management and Operations works independently under direction of the Chief Legal Officer of the Company and has responsibility for Litigation Management of the company. Additionally, this role will assist in supporting with operational matters by providing advice and support to the company's leadership, advising facility CEOs, and executive and clinical leadership. This position will have primary responsibility for managing all litigation, including overseeing and directing potential litigation matters, supervising outside litigation counsel, and evaluating and working with the liability insurance structure to provide case Management and evaluation. This position will be involved in the creation of a new enterprise risk management system and will be expected to provide proactive advice and counsel to the company on risk mitigation strategies, process improvement and enterprise strategies for risk reduction.
Duties and Responsibilities:
  • Manage and provide oversight over all litigated matters and assist in representation when appropriate.
  • Reviews insurance and risk profile of the company and evaluates coverage, case management, and direct management of outside liability counsel, while tracking and maintaining accountability for legal spend.
  • Works in conjunction with company and executives to develop process improvement initiatives to reduce the risk profile of the company.
  • Provides legal counsel on a broad range of legal issues, including, but not limited to, human resources matters, workers' compensation, FMLA matters, employment related litigation, and patient related litigation.
  • Provides case evaluation and settlement recommendations.
  • Provides active oversight, supervision, and management of outside counsel on matters of litigation and risk management.
  • Ensures familiarity and compliance with all federal and relevant state and local healthcare laws, EKRA law and regulations, Anti-Kickback Statute, Stark and related healthcare regulatory laws, including 42 CFR part 2 confidentiality of substance abuse treatment records.
  • Works collegially and effectively with company C-Suite, facility management, legal department colleagues and support staff, and has the ability to develop meaningful strategic relationships with facility level clients to assist in addressing any operational or regulatory matters or concerns.

Qualifications
Education/Experience/Skills:
  • Juris Doctorate from an accredited institution.
  • Active law license in good standing in Tennessee.
  • 3-5 years as a healthcare attorney in-house, or comparable experience at a law firm working extensively with in-house clients.
  • At least 3 years litigation and/or Litigation Management experience.
  • Requires the highest degree of professional ethics and integrity.
  • Requires attention to detail.
  • Requires outstanding judgment, analytical and problem-solving skills.
  • Strong interpersonal skills to facilitate communication with both executives at multiple levels, as well as clinicians.
  • Positive attitude, service-minded, and team-oriented.
  • Ability to use a computer and office software, such as Microsoft Word, Excel, Outlook, PowerPoint, and Adobe Acrobat.
  • Ability to anticipate legal issues and risks and develop mitigation strategies.
  • Ability to recognize when to elevate matters to the attention of the Chief Legal Officer.

Other Work Requirements:
Travel Percentage: less than 5%
Expected Hours of work: Variable, but typically 8:30 am - 5:30 pm
