Our Organization and Mission: The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.
Pay: $75,000 Annually
Position Summary: This position is in the Capital Collateral Division.
Qualifications: Admission to the Florida Bar and two years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings.
The required legal experience must be from the practice of law in a state or territory of the United States.
Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.
Other requirements: An extensive comprehension of criminal law, constitutional law, and federal habeas corpus practice is preferred.
Trial and appellate experience, along with the ability to handle time constraints, complex legal analysis, and multifaceted litigation, are minimum requirements for this position.
The Work You Will Do: The incumbent will be responsible for, but not limited to the following:

  • Represent the state in Capital collateral litigation prosecuting first-degree murder cases where the death penalty has been imposed.
  • Serve as the lead counsel or co-counsel in the state circuit and Florida Supreme Court, as well as, representing the state in habeas actions in federal district, circuit, and United States Supreme Court.
  • Litigation includes attendance at evidentiary hearings at all post-conviction and appellate stages, research, preparation of briefs, responses, motions, and other functions directly related to appeals (capital direct appeals, interlocutory actions, collateral appeals, and extra-ordinary writs).
  • Handles emergency circumstances such as preparing pleadings and appearing in court, at all levels of state and federal courts, including during the pendency of an active death warrant.
  • Responsibility also includes keeping current on all state and federal decisions directly or indirectly impacting capital cases. This includes becoming familiar with all capital cases in the office and maintaining a communications network with other capital specialists in other offices.
  • Provides advice and assistance to other attorneys with legal analysis, brief preparation, and other attending responsibilities.
