Job Description

What is Expected

The Director of Litigation has responsibilities both as a resource for the claims department and a leader in the oversight and management of the legal counsel engaged by Synergy. The position requires a solid understanding of the business and its goals, business models, and future ambitions. This ensures that legal decisions are always made in accordance with the company's needs and goals. Some specific role requirements are:

  • Oversee ALL litigated matters to assure successful outcomes whenever possible
  • Develop and review a list of Approved/Exemplary outside counsel in ALL jurisdictions.
  • Confirm that outside counsel abides by SCIC LITIGATION GUIDELINES.
  • Develop and lead the claims department's legal strategy alongside the claims director to promote and protect the company's matters.
  • Oversee delivery of legal services and resources to accomplish corporate goals, strategies, and priorities.
  • Manage the litigation process by holding assigned counsel accountable to their established budget and action items.
  • Educate the claims staff and be available to answer claims representatives' questions and review bureau documents.
  • Develop relationships with the SCIC insureds and counsel/educate on Worker's Compensation matters.
  • Oversee results of outside counsel and establish and oversee metrics to include: Defense and Containment Costs, Litigated claim outcomes, Timeliness of resolution, Communications.
  • Annual evaluation of attorney vendor results and report to senior management.
  • Maintain up-to-date knowledge of legislation, and regulations, and participate in industry events that pertain to worker's compensation, claims, or related and beneficial matters. Additionally, the Claims Director will provide expert guidance and consultation to staff on the most complex claims. Creates functional strategies and specific objectives to support the functional infrastructure and looks ahead to enact changes when needed to ensure the company is best utilizing technology, talent, and resources.
  • Participate in settlement analysis with outside counsel and confirm authority.
  • Participate in litigated case reviews with outside counsel and claims representatives every 4 months.
  • Review, when necessary, outside counsel billings and rates.
  • Keep senior management informed on major changes to legal landscape and any claims or issues that present challenging resolutions. Involve appropriate company leadership on claim issues and decisions when appropriate.

Qualifications

What You'll Need:

5-10 Years Experience in handling Worker's Compensation matters , Certified Worker's Compensation Practitioner preferred.
Interest in building out the proper legal infrastructure to support claims department needs and company growth.
Exceptional knowledge of workers comp's investigative techniques and legal precedents.
Workers Comp experience required*
