Department Description:

Construction Contract Management (CCM) provides contract management resources for the Vestas Americas Construction team; advises the Construction team on commercial and contractual issues affecting construction of our Offshore and Onshore wind projects; and ensures alignment and agreement between the project team and other stakeholders including other Construction support functions, Sales, Procurement, Transport, Legal, and Finance.

Responsibilities:
  • Supports the subcontracting pre-award coordination supporting commercial and procurement teams in the effort of securing a robust sourcing strategy making sure that risks and contractual requirements are back-to-back meeting our obligations
  • Provide interpretation, strategy and contractual expertise in subcontract execution to internal stakeholders including terms of scope, obligations, rights and remedies in context or situation in the field.
  • Identify possible contractual approaches and negotiating tactics to avoid or resolve subcontractor disputes; and implement the chosen strategy in collaboration with the project team.
  • Team leader and hands on role that supervises the function support on specific projects; draft letters, notices, change orders, and amendments in support of contract execution and review of incoming communications from counterparties and response strategies.
  • Ensure timely notices, effective change orders and amendments that are aligned with commercial strategy and in compliance with project customer contract and subcontracts.
  • Coordinate and advise on internal compliance procedures and requests and guide stakeholders through internal requests/approvals in connection with letters, notices, change orders, amendments, and commercial strategy points.
  • Provide accurate and candid assessments of contractual risks and opportunities in execution and support project team on claims management in connection with risks and opportunities. Including evaluation of claims and providing recommendations to Project Manager and other stakeholder functions.
  • Support new sales agreement negotiations and pre-award subcontracting sourcing efforts through "lessons learned" culture. Review and provide timely input on draft subcontracs during closing process. Support the handover of closed subcontracts from Procurement to Construction Project teams.
  • Develop and maintain effective professional working relationship with Vestas Americas Construction, Procurement, Transport, Sales, Legal, Finance and other departments.
  • Initiate and collaborate on internal process improvements necessary to support job requirements, including document management and reporting tools.


Qualifications:
  • MBA / JD / Engineering BS
  • 5-10 years of directly related experience in all phases of Onshore subcontract administration and management and working knowledge of contractual terms and conditions.
  • Experience working in energy-related or heavy construction related industry.
  • Experience working with subcontractors, customers and organizations with multiple operating sites or organizations.
  • Commercial issue management experience working with subcontractor claims.


Competencies:
  • Skilled oral and written communication skills with proven ability to prepare clear, concise and compelling written materials to variety of stakeholders with different levels of commercial and contractual familiarity.
  • Proven capabilities in problem solving, negotiation, conflict resolution, commercial judgment and securing back-to-back subcontracting provisions.
  • Ability to plan, organize, prioritize various tasks, and complete assigned workload to meet multiple deadlines.
  • Accurate and pragmatic approach to contract management and enforcement.
  • Should be detail oriented.
  • High proficiency with standard IT tools, including Microsoft Office, and comfort learning and using new internal IT platforms.
