Who We Are And What We Do:
A Government Entity is Tennessee's managed care Medicaid program that provides health insurance coverage to certain groups of low-income individuals such as pregnant women, children, caretaker relatives of young children, older adults, and adults with physical disabilities. A Government Entity provides coverage for approximately 1.7 million Tennesseans and operates with an annual budget of approximately $14 billion. It is run by A Government Entity with oversight and some funding from the Centers for Medicare and Medicaid Services (CMS).

Job Overview:
A Government Entity's Office of General Counsel (OGC) is responsible for providing legal advice and counsel to all divisions of A Government Entity. This job is for an Associate Counsel position in OGC's Administrative Litigation Division (ALD) which represents the agency in administrative proceedings in front of Administrative Law Judges with the Tennessee Secretary of State's Office, as well as in Chancery Court appeals of financial eligibility decisions. The ALD group provides in-house legal guidance on an ongoing basis to A Government Entity business units, including Long Term Services and Supports (LTSS), the Office of Program Integrity (OPI), Audit & Investigations, and Fiscal. This position also works regularly with other State agencies such as the Attorney General's Office and the Tennessee Comptroller of the Treasury's Office.
This position is a hybrid role where the candidate will be required to be in the office at least once a week, and as necessary for any in-person hearings, meetings, or as requested by supervisors.
Key Responsibilities:
  • RepresentA Government Entity in administrative proceedings, including appeals of medical eligibility determinations for LTSS; provider appeals of actions such as payment suspensions, terminations, or overpayment determination; and petitions for declaratory order.
  • Represent A Government Entity in appeals of financial eligibility decisions in Davidson County Chancery Court.
  • Provide legal advice and guidance on a wide range of legal issues to internal A Government Entity business units including LTSS, OPI, Audit & Investigations, and the Fiscal Division.
  • Build relationships and work collaboratively with program leadership and executive staff.
  • Conduct and complete legal research and other projects as needed by program leadership and executive staff.

Minimum Qualifications:
  • Applicants must hold a current, valid license to practice law in Tennessee or be eligible for licensure under Tennessee Supreme Court Rule 7, Article X.
  • Applicants must have demonstrable organization, communication, legal research and writing skills.
  • Applicants must have organizational skills with attention to detail, as well as the ability to work independently and prioritize assignments.
  • Applicants must have familiarity with the Tennessee Rules of Evidence, the Tennessee Rules of Civil Procedure, and the Tennessee Uniform Administrative Procedures Act (TNUAPA).
  • Applicants must maintain excellent professional and interpersonal relationships and have the ability to take on multiple tasks on a wide variety of issues.

Desirable Qualifications:
  • Litigation experience and knowledge/experience in Medicaid are strongly preferred
